Applies to: All applicants for positions with Nelnet and its affiliates and subsidiaries (collectively, “Nelnet”). The specific rights described in the “Your Rights Regarding Automated Tools” section are provided to applicants who reside in the jurisdictions described in that section (e.g., California).
This notice describes how Nelnet may use artificial intelligence and other automated tools in our hiring process, and the rights certain applicants have in connection with their use. We provide this notice in addition to, and not in place of, the information in our Applicant Privacy Policy, including our Jurisdiction-Specific Applicant Privacy Notices (e.g., our California Applicant Privacy Notice). Nelnet may update this notice from time to time; please refer to the Effective Date above to confirm you are viewing the most current version.
How We Use Automated Tools
We may use automated tools to assist our recruiters in reviewing and evaluating applications for open positions. These tools are designed to help identify evidence of the skills, experience, and other job-related qualifications relevant to the position you have applied for. The specific qualifications and characteristics a tool will assess are described in the job posting for the position.
The output of an automated tool is one input in our hiring process. A human recruiter reviews applications and decides which candidates will move forward. Automated tools are not used to assess race, color, national origin, religion, sex, gender, age, disability, or any other characteristic protected by applicable law.
Your Rights Regarding Automated Tools
Depending on where you live, you may exercise the rights described in this section. Your broader rights under applicable privacy laws — including the rights to know, correct, delete, and opt out of the sale or sharing of personal information — are described in our Applicant Privacy Policy and, depending on where you live, under one of our Jurisdiction-Specific Applicant Privacy Notices.
Information about automated tools. You may request information about the automated tools used in connection with your application, including the purpose for which a tool was used, the categories of information considered, the output generated, and how that output was used in our process.
Human review of a decision. You may request additional human review of a decision affecting your application.
Alternative process or accommodation. You may request an alternative selection process or a reasonable accommodation in connection with our use of automated tools.
Non-retaliation. Nelnet will not retaliate against any applicant for exercising any right described in this notice or under applicable law.
To make any of these requests, use the contact information below.
California Applicants
Under the California Consumer Privacy Act and its implementing regulations, applicants may have the right to opt out of the use of automated decision-making technology in certain circumstances. Nelnet’s use of automated tools as described in this notice is intended to assess your ability to perform the position you have applied for. The tools evaluate the information you submit through our application process, such as your work history, education, skills, certifications, and responses to application questions. We use these tools in a manner designed to avoid unlawful discrimination based on protected characteristics. A human recruiter reviews your application and decides whether you move forward, and you may ask that your application be reviewed by a person without reliance on the output of an automated tool. For your other rights under California law, see our California Applicant Privacy Notice.
New York City Applicants
The following additional information relates to New York City Local Law 144:
Advance notice. This notice is provided at least 10 business days before automated tools are used in connection with your application.
Data used. The automated tools used in connection with your application to process the information you submit with your application. Depending on the information you submit, the categories of information the tool uses may include your work history, education, skills, certifications, and responses to application questions, in each case as provided by you. Our retention practices are described in our Applicant Privacy Policy. Additional information specific to a tool may be requested using the contact information below.
Colorado Applicants
Effective January 1, 2027, if an automated tool materially influences a decision that results in an adverse outcome for a Colorado applicant, Nelnet will provide additional information about the decision, the role the tool played, how to obtain further information, and how to exercise rights under Colorado law, in each case in accordance with applicable law.
